kitround Retail Store Terms (kitshops)

1. Introduction

These Terms govern purchases made through the kitround retail stores, known as kitshops the platform (the “Store”), where official partners, clubs, or verified merchants sell new sports, pregamed equipment, clothing, and accessories.

The Store is operated by Circular World Limited (“kitround”, “we”, “our”), registered in the United Kingdom.
kitround provides the technology, payment systems, and buyer protection service, but each sale contract is between you and the merchant (the “Retailer”).

kitround does not take title or ownership of any products sold through the store, except where kitround is expressly identified as the seller on the product page.

2. How the Store Works

  • Retailers list new and authentic sports products for sale on the kitround Store.
  • kitround verifies their business details and payment setup through Shopify Payments.
  • When you buy, payment is processed by Stripe and securely transferred to the kitshop owner (or their nominee) once your order is confirmed.
  • A kitfee helps fund buyer protection and platform security.

kitround is not the manufacturer or direct seller of the goods unless stated otherwise on the product page.

3. Your Consumer Rights

As a consumer in the UK or EU, you have legal protections including:

  • The Consumer Rights Act 2015 (UK) and Consumer Contracts Regulations 2013, or equivalent EU laws.
  • A 14-day right to cancel most online purchases without giving a reason.
  • A right to a refund, repair, or replacement if goods are faulty, misdescribed, or not fit for purpose.

These rights apply in addition to any manufacturer warranty offered.

To cancel or return an order, contact the retailer directly via your kitround account, or email support@kitround.com.

4. Payments and kitfee

Payments are handled securely through Shopify Payments.
Funds are held in escrow until the retailer confirms dispatch or the buyer confirms receipt.

All purchases are protected under the kitfee, which may be included in the sale price of items, or added to the sale price. Where the kitfee is added to the sae price, this will be clearly displayed. 

Buyer Protection Covers:

  • Non-delivery.
  • Wrong or counterfeit items.
  • Goods not as described.

It does not cover:

  • Normal wear and tear.
  • Change of mind beyond the 14-day cooling-off period.
  • Damage caused by misuse or incorrect installation.

The kitfee charged at checkout supports these protections and dispute-handling processes. All purchases are protected under the kitfee, which may be included in the sale price of items, or added to the sale price. Where the kitfee is added to the sale price, this will be clearly displayed. 

5. Retailer (kitshops) Obligations

Retailers must:

  • Supply genuine, safe, and compliant products.
  • Honour consumer rights for returns, refunds, and warranties.
  • Comply with UK product safety and CE/UKCA marking standards.
  • Dispatch orders promptly and communicate any delays.

Retailers are solely responsible for product quality and compliance.

Retailers agree to indemnify and hold harmless kitround and Circular World Limited against any claim, loss, or liability (including legal fees) arising from products sold through their kitshop, including any claims of injury, defect, or non-compliance. 

6. Returns and Refunds

  • You have 14 days from receipt to cancel an eligible order and request a return.
  • Returned goods must be in original condition and packaging unless defective.
  • Refunds are processed once the retailer confirms receipt of the returned goods.

To start a return:

  1. Log into your kitround account.
  2. Go to your order history and select “Return item”.
  3. Follow the on-screen instructions.

If the retailer does not respond, kitround can intervene via the kitfee protection process.

7. Product Safety and Injury Disclaimer

  • Sports equipment and apparel sold through a kitshop retail store must be used as intended.
  • kitround, Circular World Limited and kitshop owners do not accept liability for injury, loss, or damage caused by incorrect use, lack of maintenance, or modification of products.

Always read and follow the manufacturer’s instructions before use. If unsure how to use or operate any purchased equipment, the equipment should not be used. kitround may provide general guidance but does not certify safety or fitness for purpose. Retailers are required to ensure products meet all applicable safety regulations before sale.

The handling of a kitfee claim does not constitute an admission of liability by kitround or circular world limited.

8. Disputes and Resolution

If there’s an issue:

  1. Contact the retailer via your kitround account.
  2. If not resolved within 5 working days, you can escalate through kitfee protection.
  3. kitround will review the evidence and make a fair decision.

kitround may refund the buyer, issue store credit, or release payment to the retailer depending on the case.
Decisions made through the internal process are final within the platform, but users still have external legal rights.

9. Data Protection and Privacy

Your data is protected under the UK GDPR and EU GDPR.
We only share necessary order and contact information with the retailer to fulfil your purchase.

10. Changes to These Terms

kitround may amend these Terms to reflect changes in law, regulation, or platform operation.
We’ll notify you of any major updates via email or platform notice.
Continued use of the Store means you accept the latest version of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by English law.
UK consumers may bring proceedings in the courts of England and Wales.
EU consumers may bring proceedings in their home country under applicable consumer law.

Limitation of liability: to the maximum extent permitted by law, kitround’s total liability to any user shall not exceed the total fees paid by that user in the twelve months prior to the event giving rise to the claim. These disclaimers, indemnities, and limitations of liability survive the termination or expiry of these terms.

Appendix A - EU Consumer and Cross-Border Sales Terms

These terms apply when an EU consumer purchases from a UK or EU-based retailer through kitround.

  • Right to Withdraw: You may cancel most purchases within 14 days of delivery for a full refund.
  • Cross-border returns: The retailer must provide a clear process and address for EU returns.
  • Product Standards: Goods sold to EU buyers must comply with EU safety and CE marking requirements.
  • Digital Services Act (DSA) Transparency: kitround will display retailer business information and cooperate with EU authorities when required.
  • Online Dispute Resolution (ODR): You can access the EU’s ODR platform for cross-border disputes: https://ec.europa.eu/consumers/odr.

1. Introduction

These Terms and Conditions (“Terms”) set out the rules for using the kitround marketplace (the “Platform”) operated by Circular World Limited.
By registering for an account or using kitround, you agree to these Terms.

kitround provides an online platform for users to list and purchase new and used sports kit and equipment. kitround is not the buyer or seller in any transaction. Instead, it acts as an intermediary platform that facilitates listings, payments, and buyer protection.

All title and ownership of items pass directly from seller to buyer at the point of sale. kitround does not take ownership of, or legal title to, any item listed on the platform.

2. Using kitround

You must:

  • Be at least 18 years old.
  • Register an account using accurate information.
  • Not use the platform for illegal, fraudulent, or harmful activity.
  • Only list genuine sports items you own or are authorised to sell.

kitround may suspend or remove accounts that breach these Terms or misuse the platform.

3. Payments and kitfee

Payments are processed via Shopify Payments, our third-party payment provider.

  • When a buyer pays for an item, funds are securely held until delivery is confirmed or a resolution period ends.
  • Once confirmed, funds (minus the kitfee and any additional postage fees) are released to the seller.
  • The kitfee funds buyer protection and dispute-handling costs.

kitfee Covers:

  • Items not received.
  • Items significantly not as described (e.g. wrong size, wrong condition, or counterfeit).
  • Items that arrive damaged or unusable due to seller negligence.

kitfee does not cover:

  • Change of mind.
  • Items correctly described but not fitting your preferences.
  • Damage caused by improper use or wear and tear.

4. Seller Responsibilities

When listing items, sellers must:

  • Accurately describe the condition, brand, and specifications.
  • Include clear images and disclose any wear, damage, or modifications.
  • Ship items safely and within the timeframe stated in the listing.
  • Comply with all applicable UK and EU product safety standards (especially for protective gear).
  • Sellers are responsible for ensuring their items comply with the UK General Product Safety Regulations 2005 and any other relevant safety legislation.

Sellers confirm that items listed:

  • Are safe and in usable condition.
  • Do not infringe trademarks or intellectual property.
  • Are not prohibited or restricted on the platform.
  • Fake brand items, or replication of global brands

kitround may remove listings or suspend sellers who repeatedly breach these obligations.

5. Buyer Responsibilities

Buyers agree to:

  • Pay promptly for purchases through the platform.
  • Inspect items upon arrival and report any issues within 7 days of receipt.
  • Use items responsibly and according to the manufacturer’s instructions.

kitround encourages all buyers to verify that any used sports equipment (especially helmets, training equipment, pads, or safety gear) remains structurally sound and fit for use.

Sellers agree to indemnify and hold harmless kitround and Circular World Limited from any claim, cost, loss, or liability (including reasonable legal fees) arising from items they list, sell, or supply through the platform, including claims related to product defects, non-compliance, or injury. kitround may, at its discretion, take over the defence or settlement of any such claim. 

 

6. Injury, Safety, and Liability Disclaimer

  • kitround does not inspect or certify items listed on the marketplace.
  • All items are sold as-is by independent sellers.
  • Buyers purchase and use items at their own risk.
  • kitround and Circular World Limited are not liable for any injury, loss, or damage resulting from the use or misuse of equipment bought through the platform.

Sellers agree to indemnify kitround against claims arising from injury, product defects, or non-compliance with safety standards.

7. Prohibited and Restricted Items

You must not list or sell:

  • Damaged or expired safety equipment (e.g. cracked helmets, perished straps).
  • Recalled items or counterfeit goods.
  • Hazardous materials.
  • Items that breach intellectual property rights.
  • Firearms, knives and any other dangerous or lethal items

kitround reserves the right to remove any listing deemed unsafe, illegal, or inconsistent with its values.

8. Disputes and Resolution

If there’s an issue:

  1. Buyers must contact the seller via kitround within 5 days of delivery.
  2. If unresolved, buyers can open a kitfee protection claim.
  3. kitround will review evidence from both sides and may refund the buyer or release funds to the seller.

kitround’s decision is final within the platform process, but it doesn’t prevent users from seeking external remedies. The handling of any dispute or refund under the kitfee process does not constitute an admission of liability by kitround or Circular World Limited. 

9. Data Protection and Privacy

kitround complies with the UK GDPR and EU GDPR.
Your data is used only for legitimate platform functions, such as processing payments, verifying users, and resolving disputes.

10. Changes to These Terms

We may update these Terms from time to time.
When changes are material, we’ll notify you by email or platform notice before they take effect.
Continued use of kitround after updates means you accept the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by English law.
If you live in the UK, you may bring legal proceedings in the courts of England and Wales.
If you live in the EU, you may bring proceedings in your local court under applicable consumer protection law.

Appendix A  EU Consumer and Cross-Border Sales Terms

This appendix applies when an EU buyer purchases from a UK or EU seller via kitround.

  • Right to Withdraw: EU buyers may have a 14-day right to cancel unless the seller is a private individual (non-trader).
  • Cross-border disputes are handled under the EU Online Dispute Resolution (ODR) platform.
  • Sellers established in the EU must comply with the Digital Services Act (DSA) and display accurate business information.
  • kitround will provide transparent data on seller identity and product origin when legally required.
  • EU buyers are entitled to remedies under the Consumer Sales and Guarantees Directive for defective goods.
